Check the rear brake switch, sometimes it likes to get stuck in the "on" position. Should be located behind the right heel guard. Lube it with some WD-40, you might have to loosen/ lower the rear brake if that doesn't work.

Thanks man. Now do I have to remove my rear brake and foot assembly to do it or can I do it without removing it?

You should be able to do it without removing it.

the switch is right behind the heel guard. two bolts that hold it on are all you need to remove. the switch just hooks into the rear brake lever and can be adjusted via the plastic nut type thing thearded to the switch. the switch just pops into the hole behind the heel guard. If you find that the rear brake switch is not the culprit then it is likely that the front brake switch is at fault. you can see/hear the switch moving where the brake lever meets the master cylinder when u pull the lever.

Are you sure the rear brake lights are on, or are they off and your brake lights don't work?
