Funny except for the fact that if the guy dies they can charge the dude for pulling the stake out. Should have just punched him in the nose and taken his bike back.

Go Aussie!
I would have put lit up the rubber and filled the stake hole with some Michelin goo....
Serves that weasel right!

Yeah that was the discussion on rr.net, and Your almost entirely right. In the US they would charge you for leaving the scene, failing to administer aid and the thief would likely have sued the bike owner and won.thatkid wrote:Funny except for the fact that if the guy dies they can charge the dude for pulling the stake out. What I really can't believe is that PIMP went all the way to Australia to find his bike!

Re: Karma for a bike thief
The only possible charge would be battery, and possibly theft. The owner wasn't involved in the accident, so he can't get leaving the scene. The "average joe" is not required to administer aid. In fact, administering aid could lead to a lawsuit down the road.R3TARD wrote:Yeah that was the discussion on rr.net, and Your almost entirely right. Pulling the stake out would be construed as aid and if the guy dies it would be manslaughter or even 2nd degree murder since the person had motive for wanting revenge for the theft of his bike.thatkid wrote: The only possible charge would be battery, and possibly theft. Re: Kharma for a bike thief
The average person in GA at least can get in trouble for not administering aid. We had in incident here locally where a man was jailed for not administering aid and died in jail here from not receiving his insulin.

Niiice. feaking Georgia jails! I've got a minute or two of experience with one.......R3TARD wrote:The average person in GA at least can get in trouble for not administering aid. here in Mich we have a 'Good Samaritan Law' which minimises legal exposure for those who come to the aid of an injured person...which also includes provisions to protect the samaritan from HAVING to "come to the aid of"-if they have NO qualifications to do so.
It will be interesting to follow this and see what the bike owner gets out of it. While funny, the punch and the theft would likely put him legally far into the wrong here.
